Master Childcare & Household Services Agreement

Applies To: Childcare, newborn care, household support, travel care, visiting family care, confinement care, family assistant services, special needs care, school-age care, occasional care, childcare pods, housekeeper services, and other approved services.

 

1. Introduction

This Master Childcare & Household Services Agreement (“Agreement”) governs all childcare, household support, family assistant, travel, visiting family, newborn, confinement, special needs, school-age, occasional, childcare pod, housekeeping, and related services coordinated by Gabi Childcare LLC (“Gabi Childcare,” “Agency,” “we,” “our,” or “us”).

This Agreement applies to any family, client, household, visitor, parent, guardian, or authorized representative (“Client,” “Family,” “you,” or “your”) who requests, books, pays for, or receives services through Gabi Childcare.

This Agreement is designed to cover current services and future services added by Gabi Childcare. If a new service is added, Gabi Childcare may update this Agreement, the Client Handbook, or the service-specific terms.

2. Services Covered

This Agreement may apply to, but is not limited to:

Full-Time Care - Regular weekly childcare or household support

Part-Time Care -  Scheduled care for fewer weekly hours

Occasional Care - Backup, evening, weekend, or as-needed care

Care Credit System - Prepaid credits used toward eligible occasional care

Confinement Care -  Prenatal, postpartum, newborn, and household support

Temporary Care - Short end care

Visiting Families Care - Care for families visiting NYC, Long Island, Westchester, or surrounding areas

Special Needs Care - Support for children with developmental, behavioral, medical, sensory, physical, or learning needs

School Age Care - Pick-up, drop-off, homework support, before or after school care

Childcare Pods / Nanny Share - Coordinated care between multiple families

Travel Nanny - Domestic or international travel support

Family Assistant - Childcare plus errands, organizing, meal prep, household support

Housekeeper - Household cleaning, laundry, organizing, and approved home support

Newborn Care - Infant and newborn support

Household Support - Meal prep, errands, organizing, laundry, light cleaning, and approved support

Other Approved Services - Services added later by Gabi Childcare

3. No Guarantee of Placement

Submitting an intake form, signing this Agreement, paying a fee, purchasing Care Credits, or requesting service does not guarantee placement or booking approval.

All services are subject to:

  • professional availability

  • schedule availability

  • family needs

  • location

  • safety requirements

  • service type

  • Gabi Childcare’s final approval

Gabi Childcare may approve, decline, pause, or discontinue services at its discretion.

4. Professionals Assigned by Gabi Childcare

All caregivers, family assistants, household professionals, newborn care specialists, confinement care specialists, travel nannies, housekeepers, and other service professionals are assigned or referred through Gabi Childcare.

The word “Professional” means any person assigned, referred, scheduled, or approved by Gabi Childcare to provide service.

 

No specific Professional is guaranteed. If a Professional becomes unavailable, Gabi Childcare may try to provide a substitute, but a substitute is not guaranteed.

5. Client Handbook

The Client acknowledges that additional policies, procedures, and service details may be included in the Gabi Childcare Client Handbook, intake forms, booking confirmations, invoices, service addendums, email confirmations, and other written materials.

These documents are part of the full client service process.

If there is a conflict between documents, Gabi Childcare may determine which policy applies based on the service type, booking date, and written confirmation.

6. Rates, Fees & Payment

Rates, minimum hours, deposits, booking fees, placement fees, Care Credit terms, membership fees, travel fees, and any additional charges will be disclosed before booking or before services begin.

The Client agrees to pay all confirmed rates, fees, and charges.

Additional charges may apply for:

  • extra children

  • travel time

  • transportation

  • parking

  • tolls

  • late-night care

  • overnight care

  • specialty care

  • sick care

  • special needs support

  • household tasks

  • schedule changes

  • expanded responsibilities

  • supplies or activity materials

  • service upgrades

  • holidays

  • last-minute requests

 

All service fees, booking fees, processing fees, and deposits are nonrefundable, unless Gabi Childcare states otherwise in writing.

 

Failure to pay on time may result in service suspension, cancellation, or termination.

 

7. Occasional Care & Care Credits

Occasional Care may include backup care, short-term care, date-night care, weekend care, daytime care, short-notice care, or temporary care.

 

Some Occasional Care services may use prepaid Care Credits.

Care Credit Rules

  • 1 Care Credit = $1

  • Care Credits must be available before booking

  • Care Credits are nonrefundable

  • Care Credits are nontransferable

  • Care Credits have no cash value

  • Care Credits expire 90 days from purchase

  • Processing fees are nonrefundable

  • Credits may only be used for eligible services

  • Expired credits cannot be extended unless Gabi Childcare approves in writing

 

Gabi Childcare may update Care Credit policies. The policy in effect at the time of service applies.

8. Booking & Scheduling

All services require advance booking and written confirmation from Gabi Childcare.

 

A request is not confirmed until Gabi Childcare confirms it in writing.

 

Written confirmation may be provided by:

  • email

  • text

  • invoice

  • client portal

  • scheduling system

  • service confirmation form

  • signed addendum

 

Requests made within 2 hours of the requested start time may be treated as short-notice requests and may have additional fees. 

 

Time beyond scheduled hours will be billed.

9. Cancellations & Schedule Changes

All cancellation and schedule change requests must be submitted in writing.

 

Unless a service-specific policy states otherwise, the following cancellation rules may apply:

 

  • 24+ hours - No cancellation fee

  • 12–24 hours - 50% of scheduled service

  • 6–12 hours - 75% of scheduled service

  • Less than 6 hours - 100% of scheduled service

 

Late bookings, short-notice changes, travel changes, expanded responsibilities, or last-minute requests may result in additional fees.

10. Rescheduling

Rescheduling is subject to availability.

If Care Credits were applied to a booking, valid credits may be reused for a future eligible booking only if the credits have not expired and the cancellation policy allows reuse.

 

Care Credits are not refundable and are not automatically extended.

11. Family Responsibilities

The Client agrees to:

  • provide complete and accurate information

  • disclose all allergies, medications, diagnoses, disabilities, behaviors, routines, safety concerns, custody issues, household rules, and special needs

  • provide emergency contacts

  • provide care instructions

  • maintain a safe home or service location

  • provide access to food, supplies, diapers, medication, equipment, or tools needed for care

  • communicate directly with Gabi Childcare about scheduling, fees, concerns, changes, and disputes

  • not ask Professionals to perform unsafe, illegal, inappropriate, or undisclosed duties

 

The Client is responsible for all conditions inside the home, hotel, Airbnb, event space, travel location, or service location.

 

Failure to disclose important information may result in immediate service cancellation or termination without refund.

12. Health, Safety & Safe Environment

Gabi Childcare may refuse, pause, or discontinue care if conditions are unsafe.

Unsafe conditions may include:

  • aggressive behavior

  • undisclosed medical needs

  • unsafe home conditions

  • unsafe pets

  • hazardous materials

  • weapons not properly secured

  • active illness not disclosed

  • unsafe sleep environment

  • unsafe travel plans

  • unsafe transportation

  • lack of emergency contacts

  • lack of required supplies

  • behavior beyond the approved care plan

 

Gabi Childcare is not responsible for harm caused by undisclosed conditions, unsafe environments, or Client-directed instructions outside normal childcare or household support expectations.

13. Sick Care

Sick care may require:

  • advance written approval

  • upgraded service fee

  • additional caregiver qualifications

  • PPE

  • health details

  • symptom disclosure

  • medication instructions

  • additional cleaning or safety steps

 

Gabi Childcare may refuse sick care if the condition is outside the scope of approved service or creates safety concerns.

14. Medication

Medication may only be given when the Client provides written authorization.

 

The Client must provide:

  • child’s name

  • medication name

  • dosage

  • time to administer

  • method of administration

  • storage instructions

  • emergency instructions

  • parent/guardian authorization

 

Medication must be clearly labeled and supplied by the family.

 

Professionals are not required to administer medication if they are not comfortable, trained, legally allowed, or approved by Gabi Childcare to do so.

15. Activities & High-Risk Activities

Activities may include indoor play, outdoor play, homework, creative activities, light learning support, walks, playground visits, meals, routines, library activities, approved outings, and other approved care tasks.

 

High-risk activities require parent/guardian direction and may be declined by Gabi Childcare.

 

High-risk activities may include:

  • swimming

  • pools

  • beach visits

  • biking

  • skating

  • trampoline parks

  • amusement parks

  • public events

  • travel outings

  • hotel pools

  • activities involving third-party vendors

 

The Client assumes responsibility for family-directed high-risk activities unless otherwise agreed in writing.

16. Transportation

Transportation must be safe, legal, and approved in advance.

 

The Client may be responsible for:

  • train fare

  • bus fare

  • taxi/rideshare

  • parking

  • tolls

  • mileage

  • travel time

  • car service for late-night care

  • safe transportation home for the Professional

 

Professionals may not transport children unless approved in writing by Gabi Childcare and the Client.

Car seats, boosters, and child safety equipment must be provided by the Client when needed.

17. Travel Nanny & Travel Care

Travel services may include domestic or international travel with the family.

Before travel begins, the Client must provide the full travel plan, including:

  • dates

  • destination

  • flight or train information

  • lodging details

  • work schedule

  • children’s routines

  • sleeping arrangements

  • meals

  • breaks

  • emergency contacts

  • travel documents needed

  • expected duties

  • off-duty time

  • payment terms

  • travel expense coverage

 

The Client is responsible for all approved travel-related costs, including:

  • airfare

  • train fare

  • ground transportation

  • meals

  • lodging

  • luggage fees

  • passport/visa-related needs, if applicable

  • travel time

  • activity fees

  • emergency costs related to the work assignment

  • safe return transportation

 

A private room may be required for overnight or travel care.

 

Travel insurance may be required or strongly recommended. Travel insurance should cover trip disruption, medical emergencies, delays, cancellations, lost luggage, and caregiver-related travel needs where applicable.

 

Gabi Childcare is not responsible for flight delays, travel disruptions, lodging issues, family itinerary changes, unsafe travel conditions, or third-party travel provider actions.

18. Visiting Families Care

Visiting Families Care may apply to families traveling to New York City, Long Island, Westchester, the Hamptons, or surrounding areas.

 

Care may occur in:

  • hotels

  • private homes

  • short-term rentals

  • Airbnb or vacation rentals

  • family residences

  • approved public locations

  • travel destinations

 

The Client is responsible for confirming that childcare is permitted at the location.

 

The Client must provide:

  • safe care space

  • building access

  • hotel room access instructions

  • emergency contacts

  • child supplies

  • food and routine details

  • travel schedule

  • caregiver parking or transportation details, if needed

 

Gabi Childcare is not responsible for hotel, Airbnb, building, host, venue, or property rules.

19. Confinement Care, Newborn Care & Postpartum Support

Confinement care may include prenatal, postpartum, newborn, infant, household, meal, rest, routine, and family support.

 

Care may be inspired by traditional and modern postpartum practices, including culturally respectful support for families who request it.

 

Gabi Childcare does not replace a doctor, nurse, lactation consultant, doula, therapist, or medical provider unless a specific licensed professional is separately contracted and approved in writing.

 

The Client is responsible for medical decisions, postpartum medical care, newborn medical care, feeding decisions, and instructions from licensed healthcare providers.

20. Special Needs Care

Special needs care may include support for children with developmental, learning, behavioral, emotional, physical, sensory, medical, or daily living needs.

The Client must disclose all known needs before care begins, including:

  • diagnosis

  • behavior concerns

  • communication needs

  • mobility needs

  • sensory needs

  • medical needs

  • allergies

  • medication

  • feeding needs

  • toileting needs

  • safety risks

  • elopement risk

  • aggression or self-injury risk

  • school plans or care plans, if applicable

 

Gabi Childcare will use the information provided to help determine whether an appropriate caregiver match may be available.

 

Gabi Childcare does not guarantee that every child’s needs can be supported.

21. School-Age Care, Pick-Up & Drop-Off

School-age care may include:

  • school pick-up

  • school drop-off

  • before school care

  • after-school care

  • homework support

  • snack or meal support

  • transportation coordination

  • activity drop-off or pick-up

  • routine support

The Client must provide:

  • school name

  • address

  • authorized pick-up information

  • teacher or office contact

  • dismissal instructions

  • emergency contact

  • transportation instructions

  • child’s schedule

  • permission forms, if required

Gabi Childcare is not responsible for school delays, school policy changes, transportation delays, or incorrect information provided by the Client.

22. Childcare Pods / Nanny Share

Childcare pods or nanny share services involve coordinated care between two or more families.

Gabi Childcare may help coordinate:

  • family matching

  • caregiver matching

  • care schedule

  • host family rotation

  • general care expectations

  • child count

  • shared payment structure

  • service terms

The families are responsible for their own homes, safety conditions, household rules, supplies, and agreements between families.

Gabi Childcare is not responsible for:

  • disputes between families

  • conditions inside a host family’s home

  • household damage

  • family-to-family payment disputes

  • family-to-family communication issues

  • host home safety problems not disclosed to Gabi Childcare

Each family may be required to sign the Master Agreement and any pod-specific addendum.

23. Family Assistant Services

Family Assistant services may include childcare plus approved household support.

Tasks may include:

  • Meal prep

  • child laundry

  • organizing child areas

  • errands

  • school prep

  • activity prep

  • homework support

  • household routines

  • grocery support

  • light tidying related to children

  • approved family support tasks

Family Assistant services are not unlimited household labor. Duties must be approved in writing.

Expanded duties may require a higher rate or service upgrade.

24. Housekeeper Services

Housekeeper services may include approved household cleaning and organization tasks.

Tasks may include:

  • cleaning

  • laundry

  • dishes

  • organizing

  • changing linens

  • household upkeep

  • approved errands

  • light meal prep, if included

The Client must provide safe cleaning supplies and disclose allergies, pets, fragile items, special surfaces, and household risks.

Gabi Childcare is not responsible for damage caused by undisclosed fragile items, unsafe supplies, unclear instructions, or pre-existing household conditions.

25. Pets

The Client must disclose all pets before service.

The Client must provide:

  • pet type

  • pet behavior

  • safety concerns

  • feeding or walking expectations, if any

  • areas where pets are allowed

  • emergency instructions

Professionals are not required to provide pet care unless approved in writing.

Aggressive, unsafe, or undisclosed pets may result in refusal or cancellation of service.

26. Supplies, Food & Equipment

The Client is responsible for providing all supplies needed for service, including:

  • diapers

  • wipes

  • formula

  • bottles

  • food

  • snacks

  • medication

  • stroller

  • car seat

  • cleaning supplies

  • keys or access codes

  • emergency supplies

  • activity supplies

  • household tools

  • child-specific equipment

Gabi Childcare may charge additional fees if supplies must be purchased, delivered, or arranged.

27. Communication

Gabi Childcare is the main point of contact for:

  • scheduling

  • cancellations

  • rate changes

  • service changes

  • complaints

  • payment questions

  • disputes

  • caregiver replacement requests

  • policy questions

Professionals are not authorized to approve schedule changes, rate changes, refunds, discounts, disputes, or service modifications without Gabi Childcare’s written approval.

28. Screening, Compliance & Professional Standards

Gabi Childcare may screen Professionals through methods such as:

  • background checks

  • fingerprinting, where applicable

  • reference checks

  • interviews

  • experience review

  • identity verification

  • training review

  • re-screening at Gabi Childcare’s discretion

Gabi Childcare will make commercially reasonable efforts to provide vetted and qualified Professionals.

29. Direct Hiring / Non-Solicitation

The Client may not directly hire, employ, book, pay, engage, or privately contract with any Professional introduced, referred, scheduled, or assigned by Gabi Childcare unless allowed under Gabi Childcare’s written placement policy.

This restriction applies during service and after service ends for the period stated in Gabi Childcare’s placement policy or signed agreement.

Violation may result in placement fees, damages, termination of service, or legal action.

30. Third-Party Providers

Third-party providers may include hotels, venues, schools, drivers, rideshare companies, activity vendors, travel companies, airlines, building staff, restaurants, event vendors, or medical providers.

Third-party providers operate independently.

Gabi Childcare is not responsible for their actions, delays, rules, safety issues, cancellations, or services.

31. Insurance & Risk Allocation

Gabi Childcare maintains commercially reasonable insurance coverage for its operations.

Coverage may include, as applicable:

  • General Liability

  • Professional Liability

  • Cyber Liability

  • Business Auto Liability

  • Abuse/Molestation Liability

  • Commercial Umbrella Insurance

  • Special Event Liability

  • Participant Accident/Medical coverage for events or programs

  • Inland Marine/Equipment Coverage

  • Commercial Property coverage

Coverage depends on the terms, limits, conditions, and exclusions of the applicable policies.

Nothing in this Agreement guarantees insurance coverage for any specific incident.

32. Limitation of Responsibility

To the fullest extent permitted by law, Gabi Childcare is not responsible for delays, interruptions, cancellations, losses, damages, or service changes caused by events outside its reasonable control.

This may include:

  • weather

  • natural disasters

  • public health emergencies

  • government orders

  • transportation delays

  • flight changes

  • school closures

  • family travel changes

  • unsafe conditions

  • third-party provider issues

  • venue issues

  • building access issues

  • undisclosed child or household needs

  • Client-directed instructions outside approved duties

33. Limitation of Liability

To the fullest extent permitted by law, Gabi Childcare’s total liability shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

This limitation does not apply where prohibited by law.

34. Indemnification

The Client agrees to indemnify, defend, and hold harmless Gabi Childcare, its owners, employees, contractors, agents, and Professionals from claims, damages, losses, costs, or liabilities arising from:

  • conditions in the home or service location

  • family-directed activities

  • undisclosed medical, behavioral, developmental, or safety concerns

  • third-party providers

  • unsafe instructions

  • travel disruptions

  • childcare pod host home conditions

  • family-to-family disputes

  • property access issues

  • violation of this Agreement

35. Refunds

All fees are nonrefundable unless Gabi Childcare states otherwise in writing.

Nonrefundable fees may include:

  • booking fees

  • service fees

  • processing fees

  • deposits

  • membership fees

  • Care Credits

  • consultation fees

  • placement fees

  • travel planning fees

  • event planning fees

  • administrative fees

36. Policy Updates

Gabi Childcare may update this Agreement, the Client Handbook, service policies, rates, fees, and procedures at any time.

The version in effect at the time of booking or service will apply unless otherwise required by law or stated in writing.

Clients are responsible for reviewing updated policies when provided or posted.

37. Termination of Services

Gabi Childcare may refuse, pause, cancel, or terminate services at any time for reasons including:

  • safety concerns

  • non-payment

  • disrespectful conduct

  • harassment

  • discrimination

  • policy violations

  • unsafe home or travel conditions

  • undisclosed care needs

  • aggressive behavior

  • inappropriate requests

  • direct hiring violations

  • repeated cancellations

  • professional unavailable and no substitute available

No refunds will be issued when services are terminated due to safety concerns, policy violations, non-payment, or Client misconduct.

38. Governing Law

This Agreement is governed by the laws of the State of New York.

Any legal action or proceeding related to this Agreement shall be brought in the appropriate courts located in New York County, New York, unless otherwise required by law.

39. Digital Signature & Acknowledgment

By signing, submitting an intake form, purchasing Care Credits, paying an invoice, booking services, or using services, the Client confirms that they:

  • read this Agreement

  • understand the terms

  • agree to follow Gabi Childcare policies

  • provided true and complete information

  • understand that services are not guaranteed until confirmed

  • understand that fees may be nonrefundable

  • agree to the Client Handbook and service-specific terms

  • understand that digital signatures are legally binding
