Occasional Care Services Agreement
1. Introduction
This Occasional Care Services Agreement ("Agreement") is entered into between Gabi Childcare LLC ("Agency") and the undersigned client ("Family") for the provision of occasional, backup, and short term childcare services.
The Family acknowledges that additional policies, procedures, and service details are outlined in the Handbook, which forms part of this Agreement.
2. Definitions

“Professional” refers to any caregiver or family assistant assigned by the Agency.

“Services” refers to childcare, household support and related support arranged through the Agency.

“Care Credits” refers to prepaid funds applied toward services.
3. Scope of Occasional Care Services
Services are provided on an as needed basis and may include backup care, daytime or evening care, and short notice requests, subject to availability. Services are not confirmed until approved in writing by the Agency.
4. Rates
Rates and applicable fees are communicated prior to booking and are subject to change. Payment is required in accordance with the terms of this Agreement.
Failure to make timely payment may result in suspension or termination of services.
5. Care Credits
Services are provided through prepaid Care Credits.

Credits are non-refundable, non-transferable, and have no cash value

Credits expire 90 days from purchase
The Agency reserves the right to modify credit policies. The policy in effect at the time of service applies.
Processing fees apply to all purchases and are non-refundable.
6. Schedule & Booking
All services require advance booking and written confirmation.

Requests within 2 hours = short notice

Availability is not guaranteed

Time beyond scheduled hours will be billed
7. Cancellations & Changes
All requests must be submitted in writing.

24+ hours: No fee
-
12–24 hours: 50%
-
6–12 hours: 75%
-
<6 hours: 100%
Late bookings and last-minute changes may incur additional fees.
8. Rescheduling & Credits
Rescheduling is subject to availability.
Applied credits may be reused for future bookings if within expiration. Credits are not refundable or extendable.
9. Family Responsibilities
The Family agrees to:

Provide accurate and complete information

Maintain a safe environment

Provide emergency contacts and care instructions
-
Communicate directly with the Agency
The Family is responsible for all conditions within the home or service location.
10. Health & Safety
The Agency may refuse or discontinue care if conditions are unsafe.
Sick Care
Sick care requires an upgrade, additional fees, and possible PPE.
Medication
Medication requires written authorization.
Activities
All high-risk activities occur at the Family’s direction and risk.
11. Transportation & Travel
The Family is responsible for all travel-related costs.

Travel time may be billed

Private room required for overnight care

Safe transportation required for late hours
Travel insurance may be required.
12. Agency Responsibilities
The Agency will:

Provide vetted professionals
-
Maintain insurance and compliance
-
Provide support and communication
No specific professional is guaranteed.
13. Safety & Compliance
All professionals undergo screening, which may include:

Background checks
-
Fingerprinting
-
Reference verification
Re-screening may occur at the Agency’s discretion.
14. Communication & Support
The Agency is the primary point of contact.
Professionals are not authorized to approve changes or resolve disputes independently.
15. Billing & Fees
Booking fees are non-refundable.
Additional charges may include:

Travel
-
Late hours
-
Extra children
-
Specialty services
Invoices must be paid according to agreed terms. Late payments may result in service suspension.
16. Force Majeure
The Agency is not liable for delays or cancellations due to events beyond its control.
Services may be rescheduled. Credits may be reapplied if valid.
17. Limitation of Liability
To the fullest extent permitted by law, the Agency’s total liability shall not exceed the total amount paid by the Family for services.
18. Indemnification
The Family agrees to indemnify and hold harmless Gabi Childcare from any claims, damages, or liabilities arising from:

Conditions within the home or service location

Family-directed activities
-
Third-party providers
19. Third Party Services
All third-party providers operate independently. The Agency is not responsible for their actions or services.
20. Policy Modifications
The Agency may update this Agreement and all related policies at any time. The version in effect at the time of service governs.
21. Termination
The Agency may refuse or discontinue services at any time due to:

Safety concerns

Policy violations
-
Non-payment
No refunds will be issued in such cases.
22. Governing Law
This Agreement is governed by the laws of the State of New York.
23. Acknowledgment
By signing, the Family confirms they have read and agree to this Agreement and the Handbook.
Digital signatures are legally binding.
